Brewhound Bus Liability Waiver

The participant in consideration of being permitted to participate in the Brewhound Bus/Brewhound Bus Tour as a result from booking. The receipt of which is hereby acknowledged, does hereby release, hold harmless, and indemnify Brewhound Bus Tours LLC, Brewhound, Brewhound Tours: its members, managers, officers, employees, independent contractors, agents, volunteers, and host venues from any and all claims related to participation in Brewhound Bus rental. Whether such participation is before, during or after Brewhound Bus rental, including without limitation any claim for damages arising from any action in breach of contract, intentional tort, or negligence, whether such a claim for damages is restitution, incidental, consequential, exemplary, or punitive.

Participant acknowledges he/she is at least 21 years of age, warrants that he/she is sufficiently healthy to participate in Brewhound Bus rental and comprehends and assumes all risk associated with participation in Brewhound Bus rental, including without limitation illness, allergies, health issues, theft of or damage to Participants property, transportation (both failure of transportation and injury during transportation due to any cause), inclement weather and any injuries, death or damages, caused thereby. Participant acknowledges that Brewhound Bus are conducted at Independent restaurants and/or venues not owned or controlled by Brewhound Bus and cannot guarantee or ensure the performance of any vendors, nor can favorable weather conditions be guaranteed.

Participant is responsible for and accepts full responsibility for complying with Indiana law regarding consumption of alcohol, and consuming alcoholic beverages, monitoring and/or limiting his/her alcoholic beverage intake. Participant is responsible for his/her transportation to and from the start and end points of Brewhound Bus rental. Participant also gives Brewhound Bus a worldwide transferable irrevocable license to use Participant’s likeness (through photographs, film, digital or video) for the limited purpose of promoting future events and/or obtaining press coverage of Brewhound Bus.

I HAVE READ THIS RELEASE AGREEMENT, FULLY UNDERSTAND ITS TERMS AND HAVE SIGNED IT FREELY WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT OF THE LAW OF THE STATE OF INDIANA AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID, THE OTHER TERMS HEREIN SHALL CONTINUE IN FULL FORCE AND EFFECT. BY PURCHASING A Brewhound Bus Tours LLC RENTAL, I HEREBY AGREE TO ALL THE TERMS OF THIS AGREEMENT.
